These Terms remain in effect unless and until terminated by either you or us. You may terminate by notifying us you no longer wish to use our services or by ceasing to use the site.
We may also terminate this agreement at any time, without notice, if we determine that you have violated any part of these Terms. In such cases, you will still be responsible for any outstanding amounts up to the termination date, and we may restrict or revoke your access to the site and services.
Entire Agreement
Our failure to enforce any part of these Terms of Service does not waive our right to enforce such provision in the future. These Terms of Service, along with any policies or rules posted on this site or related to the Service, represent the complete agreement between you and RPM Pickleball.
They supersede all previous agreements, communications, or proposals—whether oral or written—between you and us (including any prior versions of these Terms). Any uncertainties in interpreting these Terms shall not be interpreted against the party who drafted them.

These Terms of Service, along with any other agreements through which we provide you services, are governed by and interpreted in accordance with the laws of the State of California.
SMS/MMS Mobile Messaging Program Terms and Conditions
RPM Pickleball ("we," "us," or "our") offers a mobile messaging program (the "Program"). By enrolling in or participating in the Program, you agree to these terms as well as our Privacy Policy. Participation constitutes consent to resolve any disputes through individual arbitration, as outlined in the “Dispute Resolution” section.
Opt-In:
You can join the Program by opting in through online forms or other enrollment methods. By doing so, you agree to receive marketing text messages (which may be sent using an autodialer or prerecorded voice system) to the phone number you provided. Consent is not required for any purchase. Message and data rates may apply. By providing your number, you authorize us to contact you about our products and offers. You may revoke consent at any time.
Opt-Out:
To unsubscribe, text STOP to +0000000000 or use the unsubscribe link (if available) in a message. After opting out, you’ll receive one confirmation message and then no further messages unless you re-initiate contact. To unsubscribe from other RPM Pickleball text programs, you must follow each program’s specific opt-out instructions.

User Responsibility & Indemnification:
If you stop using the mobile number you registered with, you must opt out before deactivating or transferring the number. Failure to do so may result in legal liability. You agree to indemnify RPM Pickleball and any involved parties from any claims, costs, or liabilities (including legal fees) resulting from your failure to properly notify us of changes to your mobile number.
Program Overview:
Participants can expect recurring text messages about our products, services, events, and promotions. Frequency varies depending on your interactions with us.
MMS Disclosure:
If your device does not support MMS, we may send SMS messages instead.
Disclaimer:
The Program is provided “as is” and may not function in all areas or under all conditions (e.g., device or network limitations). We are not liable for delays or failed message delivery. Your carrier’s coverage and technology may impact the Program’s effectiveness. T-Mobile and other carriers are not responsible for undelivered messages.
Participant Requirements:
You must be a wireless service subscriber using a supported device and carrier. Not all carriers support the Program. You must be 13 or older to participate. Users between 13 and 18 must have parental or guardian permission. By using the Program, you confirm that you meet the applicable age and legal requirements.
Prohibited Content:
You may not send content that is illegal, harassing, defamatory, obscene, discriminatory, or otherwise harmful, including any unauthorized health-related information or malicious software. Messages promoting unlawful goods or services are strictly prohibited.
Dispute Resolution
Any disputes arising from your use of the Program or your interactions with us—including legal claims—must be resolved through binding arbitration in Irvine, California, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Arbitration will be conducted by a qualified arbitrator agreed upon by both parties or appointed by the AAA.
The arbitrator may not award punitive damages and cannot hear class-action claims. Each party is responsible for its own costs unless the arbitrator orders otherwise. The decision will be final and binding, and limited appeal rights apply under the Federal Arbitration Act (FAA).
Arbitration details are confidential unless both parties agree otherwise. If a court proceeding occurs for any reason, both parties waive their right to a jury trial. This provision survives termination of your participation in the Program.
Miscellaneous
You confirm that you have the authority to agree to these Terms and that doing so does not breach any other agreement you may have. A party’s failure to enforce any right does not waive that right. If any provision is found unenforceable, the rest of the Agreement will remain in effect.
Any new features or updates to the Program will be subject to this Agreement unless stated otherwise. We may update these terms at any time, and you are responsible for reviewing them periodically. Your continued participation in the Program after changes are posted constitutes your acceptance of those changes.
Changes to Terms of Service
We reserve the right to modify these Terms of Service at any time by posting updates on our website. It’s your responsibility to check for changes periodically. Continued use of the site or services after changes are posted means you accept those changes.
